THE OBSTACLE IN IMPLEMENTATION OF DIVERSION TO CHILDREN WERE IN CONFLICT WITH LAW BY THE PROSECUTOR IN STATE ATTORNEY WONOSARI

Abstract


This research to describe the obstacles in implementation of the diversion on child conflict with law by the publik prosecutor in State Attorney Wonosari. In addition , the research also to describe efforts the prosecutor in wonosari attorney office in any constraints on the implementation of diversity on child conflict with law. This is kind of descriptive research who makes qualitative method approach. Subjects of research is determined by purposive technique. Subject of research are three prosecutors from the General Crimes Section. Collecting data using interview techniques and documentation. Examination technique of the validity data using the cross check. Inductive data analysis techniques through data reduction, the unitization and categorization, display data, and conclusions. The results of research showed that, the public prosecutor in the State Attorney Wonosari experiencing internal and external obstacles in implementing the diversion of children in conflict with the law. Internal obstacles, including: 1) reaching agreement between the victim and the children in conflict with the law; 2) Human Resources (HR) related to the child's special public prosecutor. External obstacles : 1) Lack of adequate infrastructure in the process of diversion; 2) Different understanding in handling children in conflict with the law among law enforcement officers; 3) coordination between the public prosecutor and the society adviser; 4) public understanding about the diversion; 5) regulations regarding the supervision of the implementation of the diversion agreement. Efforts to the prosecutor in wonosari attorney office in overcoming internal obstacles: 1) held a separate meeting (caucus) to reach an agreement; 2) prepare a work plan and maximize the performance of each prosecutor in the case of child lawsuit handling. The effort of overcoming external obstacles: 1) optimizing infrastructure; 2) use the power of social welfare in the diversion process; 3) establish intensive communication with other law enforcement officers; 4) improving coordination with community mentors; 5) hold a socialization about diversion in the community; 6) making an agreement on the supervision of the implementation of the diversion agreement.
