THE ROLE OF THE POLICE IN THE RESORT OF BANTUL FILED A LAWSUIT AGAINST THE DIVERSION OF CHILD CRIME

Abstract


ABSTRACT

The purpose of this research is to elaborate on the role of the Police in the Resort of Bantul diversion against the matter a criminal offence the child, knowing the obstacles faced from the role of the Police in the Resort of Bantul diversion against the matter a criminal offence, and uncover the Resort Police efforts made to overcome obstacles in Bantul was his role in the crime litigation against diversion. This research is descriptive research approach to qualitative research methods. The subject of the research is determined by purposive technique. Using data collection techniques interviews and documentation. The technique of the validity of the data using the cross check. The data were analyzed by means of the reduction of the data, the presentation of data, and the withdrawal of the conclusion. The results showed that: (1) the role of the Police in the Resort of Bantul, filed a lawsuit against the diversion of children, criminal acts include: a) the receipt of a report or a complaint from someone, b) the process of making a police report, c) callings, and d) process the implementation of diversion; (2) obstacles faced from the role of the Police Resort to Bantul i.e. There are internal and external barriers. Internal obstacles include: a) no budget provided by the Government of b) limitations of the scope for action of diversion, while the external obstacles include: a) the existence of the intervention of some civil society or the family of the victim, b) difficulty scheduling to bring together the parties, c) victims/family party less/not yet understand about the diversion; (3) the efforts made the Resort Police Bantul is the attempt to internal barriers include: a) filed a request for assistance to P2TP2A, b) use empty spaces, whereas efforts to overcome external obstacles include: a) gives an understanding to the parties of the provisions of the law number 11 Year 2012, b) locate and specify the time for the parties to attend a diversion action, c) explained to the victim about the duty of investigators to seek diversion.
